The complaint alleges that a person opening an account on the Binance.US exchange had to use Jumio's identity verification software, which requires applicants to share a photo ID and a selfie. It alleges the defendants collected his biometric data without written consent and did not explain how it would be managed, as the Illinois Biometric Information Privacy Act requires. The proposed class covers Illinois residents who held Binance.US accounts and whose biometric data was collected before May 25, 2021. In 2023 a federal judge rejected motions to dismiss from two of the three defendants and dismissed Binance Capital Management for lack of jurisdiction.
