Some AI incidents may involve sensitive information.
Depending upon the report, information submitted to Wayward Fowl could potentially concern matters such as:

- age;
- sex or gender;
- disability;
- health information;
- employment;
- financial circumstances;
- immigration or citizenship information;
- biometric information;
- precise location;
- government identifiers; or
- other sensitive information.
Do not provide sensitive information unless it is reasonably necessary to understand or document the incident.
In particular, please do not unnecessarily submit:
- Social Security numbers;
- passwords;
- authentication codes;
- complete bank-account numbers;
- complete payment-card numbers;
- driver’s-license numbers;
- passport numbers;
- detailed medical records;
- private home addresses;
- information concerning minors;
- biometric identifiers; or
- other highly sensitive information.
Where sensitive information is relevant, redact unnecessary portions whenever reasonably possible.
Wayward Fowl may redact, restrict, or remove sensitive information.

Incident reports may contain information about individuals other than the person submitting the report.
For example, a report may identify:

- managers;

Wayward Fowl may redact names or other identifying information where appropriate.
5Information About People Who Did Not Submit A Report
Wayward Fowl may process personal information about you even if you have never created an account or directly provided information to us.

- a dispute;

A central function of Wayward Fowl is creating a public record of reported AI incidents.
Accordingly, information submitted for public reporting may be published on the Platform.
Published information may include:
- incident descriptions;
- AI systems involved;
- companies or organizations involved;
- relevant dates;
- categories of alleged harm;
- supporting evidence;
- reporter-selected demographic or contextual information;
- responses;
- corrections;
- dispute notices; and
- other information relevant to understanding an incident.
Do not submit information for public reporting that you are unwilling to have published, except where the Platform expressly indicates that particular information will be treated as nonpublic.
11Reporter Identity
Wayward Fowl may offer different identity options for incident reporters.
Depending upon the features available, these may include:
Public identity — your name may appear with the report.
Pseudonymous publication — a chosen identifier may appear instead of your name.
Anonymous public display — your identity may not be displayed publicly with the report.
If Wayward Fowl offers anonymous public display, this means that your identity is not intentionally displayed as part of the public report. It does not necessarily mean that Wayward Fowl possesses no information capable of identifying you.
For example, Wayward Fowl or its service providers may possess:
- account information;
- email addresses;
- IP addresses;
- device information;
- communications;
- document metadata; or
- other information associated with the Submission.
Accordingly, Wayward Fowl does not guarantee absolute anonymity.
12Reporter Confidentiality
Where Wayward Fowl expressly agrees to keep a reporter’s identity nonpublic, we will seek to handle that information in accordance with this Policy and the representations made through the applicable Platform feature.
However, we may disclose information when required or permitted by applicable law, including in response to valid legal process.
We may also disclose information where reasonably necessary to protect against fraud, security threats, or serious threats to safety, subject to applicable law.
13Legal Process
Protection of Reporter Identity
Wayward Fowl recognizes that some individuals may have legitimate concerns about retaliation or other consequences associated with reporting an AI-related incident.
Where a reporter submits information on an anonymous or pseudonymous basis, or where Wayward Fowl otherwise agrees to keep the reporter's identity nonpublic, Wayward Fowl will not voluntarily disclose the reporter's nonpublic identity to a person or organization identified in the report merely because that person or organization requests the information.
If Wayward Fowl receives a subpoena, court order, or other legal demand seeking information that could identify an anonymous or pseudonymous reporter, Wayward Fowl will evaluate the request and its legal obligations. Where legally permitted and reasonably appropriate, Wayward Fowl may object to, seek to narrow, or challenge legal process seeking disclosure of a reporter's identity.
Where legally permitted and reasonably practicable, Wayward Fowl may attempt to notify the affected reporter before disclosing information that identifies the reporter so that the reporter may have an opportunity to seek independent legal advice or pursue available legal remedies.
Nothing in this policy guarantees absolute anonymity or confidentiality. Wayward Fowl may disclose information where required by applicable law or valid legal process and cannot guarantee that an individual's identity will never be independently discovered.

Publicly
Information designated or submitted for public reporting may be published through the Platform.
Service Providers
We may provide information to companies that perform services on our behalf, such as:

We will seek not to disclose a reporter’s nonpublic identity through this process unless disclosure is appropriate under the applicable Platform feature, authorized by the reporter, or otherwise permitted by this Policy and applicable law.
Professional Advisers
We may disclose information to attorneys, accountants, auditors, insurers, consultants, security professionals, and other advisers where reasonably necessary.
Legal and Safety Purposes
We may disclose information where reasonably necessary to:
- comply with law;
- respond to legal process;
- enforce our agreements;
- investigate fraud;
- protect Wayward Fowl;
- protect users;
- protect the public; or
- address security or safety threats.
Corporate Transactions

16Advertising
If Wayward Fowl introduces advertising or sponsorships, we may update this Policy to explain the information used in connection with those activities.
We do not intend to allow advertisers to target advertisements based on sensitive personal information contained in incident reports.
Advertising or commercial relationships should not determine whether Wayward Fowl publishes, suppresses, corrects, or modifies an incident report.
17Artificial Intelligence And Automated Processing
Wayward Fowl may use artificial intelligence and automated systems to assist with Platform functions such as:

- summarization;
- duplicate detection;
- moderation;
- redaction;
- search;
- translation;
- trend analysis;
- fraud detection; and
- other Platform operations.
Automated systems may make mistakes.
Where appropriate, Wayward Fowl may use human review in connection with significant moderation, publication, correction, or dispute decisions.
We do not intend to use incident-report information to make decisions concerning an individual’s eligibility for employment, credit, housing, insurance, healthcare, education, or similar opportunities.
18Ai Model Training
Unless Wayward Fowl provides clear notice otherwise, Wayward Fowl will not use nonpublic incident submissions containing personal information to train general- purpose artificial intelligence models for unrelated commercial purposes.
Wayward Fowl may use information to operate, evaluate, secure, and improve Platform- specific systems, including classification, moderation, search, duplicate detection, redaction, and analytical tools, subject to applicable law and appropriate safeguards.
Wayward Fowl may also use aggregated or de-identified information for research, product improvement, and analysis.
19Aggregated And De-Identified Information
Wayward Fowl may create aggregated or de-identified information from information collected through the Platform.
For example, we may publish statistics concerning:
- categories of reported AI harm;
- industries involved;
- AI systems identified;
- trends over time;
- geographic patterns;
- types of decisions involved; and
- reported outcomes.
Where information has been appropriately de-identified, we may use it for research, analysis, product development, publication, and other lawful purposes.
We will not attempt to re-identify information that we maintain as de-identified except as permitted by applicable law, such as for testing whether de-identification measures are effective.
20Data Retention
We retain personal information for periods reasonably necessary for the purposes described in this Policy, including:
- operating the Platform;
- maintaining incident records;
- preserving correction histories;
- resolving disputes;
- preventing fraud and abuse;
- complying with law;

Different categories of information may have different retention periods.
Because Wayward Fowl is intended to maintain a historical record of reported AI incidents, published reports and information incorporated into the public incident record may be retained for extended periods.
Closing an account does not necessarily result in deletion of previously published incident reports.
21Deletion Requests
You may request deletion of certain personal information associated with you, subject to applicable law and exceptions.
A deletion request does not necessarily require Wayward Fowl to delete:
- public incident reports;
- information concerning matters of public interest;
- information necessary to document corrections or disputes;
- information necessary for legal claims;
- security records;
- fraud-prevention records;
- information required by law;
- appropriately de-identified information; or
- information Wayward Fowl is otherwise permitted to retain.
Where appropriate, Wayward Fowl may remove identifying information while retaining an incident record.
22Corrections
You may request correction of inaccurate personal information.
If the requested correction concerns information contained in an incident report, the request may also be handled under our Corrections and Dispute Policy.
The fact that someone disputes an allegation does not necessarily mean that Wayward Fowl will treat the underlying information as factually inaccurate.
23Privacy Rights
Depending upon where you live, applicable law may provide rights concerning your personal information.
These may include rights to:
- know or access personal information;
- obtain information concerning processing;
- correct inaccurate information;
- delete certain information;
- obtain a portable copy of certain information;
