These Incident Submission Terms (the “Submission Terms”) apply whenever you submit an incident report, supporting documentation, evidence, response, comment, or other information (collectively, a “Submission”) to Wayward Fowl Inc. (“Wayward Fowl,” “we,” “us,” or “our”).
These Submission Terms supplement the Wayward Fowl Terms of Use and Privacy Policy.
By submitting an incident report, you agree to these Submission Terms.
1Purpose Of Wayward Fowl
Wayward Fowl operates an independent platform for reporting, documenting, organizing, analyzing, and increasing public awareness of incidents and concerns involving artificial intelligence systems and related technologies.
Reports submitted to Wayward Fowl may become part of a publicly accessible record of reported AI-related incidents.
Wayward Fowl is not a government agency, regulator, court, law-enforcement organization, consumer-reporting agency, or official dispute-resolution service.
Submitting a report to Wayward Fowl does not constitute filing an official complaint with any governmental or regulatory authority.
2Your Report
You are responsible for the information you submit.
By making a Submission, you represent that, to the best of your knowledge and belief:
1. the material factual information you provide is truthful and accurate;
2. you have a reasonable factual basis for statements you present as facts;
3. you are not knowingly submitting false, fabricated, deceptive, or materially
misleading information;
4. you have described the incident in good faith;
5. where reasonably possible, you have distinguished facts from your opinions,
beliefs, suspicions, interpretations, or conclusions;
6. you have not knowingly altered, fabricated, or manipulated supporting evidence in a
way that materially misrepresents what occurred;
7. you have the right to submit the information and materials you provide;
8. your Submission does not knowingly violate applicable law or another person’s
rights; and
9. you understand that information submitted for public reporting may be published
and become publicly accessible.
You are not required to prove that an AI system caused an incident in order to report your experience.
You should describe what happened as accurately as you reasonably can and identify uncertainty where appropriate.
3Firsthand And Other Information
Where reasonably possible, please identify whether information in your Submission is:
- something you personally experienced or observed;
- information contained in a document or other record;
- information another person told you;
- your opinion or interpretation; or
- information obtained from another source.
If you are reporting an incident that you did not personally experience, you should identify the source or basis for the report where reasonably possible.
Do not represent secondhand information as something you personally witnessed.
4Allegations Are Not Established Facts
Wayward Fowl is designed to permit people to report suspected AI-related incidents, including situations in which the precise role of an AI system may not yet be known.
You may explain why you believe an AI system contributed to an incident.
However, you should not characterize an allegation, suspicion, inference, or disputed conclusion as an established fact unless you have a reasonable factual basis for doing so.
For example, describing the outcome you experienced and why you believe an automated system contributed to it is different from asserting as an established fact that a particular company intentionally discriminated against you.
5Supporting Evidence
Where available and appropriate, Wayward Fowl may permit you to provide materials supporting your report, including:
- emails;
- letters;
- screenshots;
- photographs;
- notices;
- decisions;
- reports;
- transaction records;
- AI outputs;
- chat transcripts;
- application records;
- correspondence; and
- other relevant documentation.
Supporting documentation may help Wayward Fowl and its users understand an incident.
However, do not upload material merely because the Platform allows you to upload it.
You are responsible for determining whether you have the right to provide the material.
6Do Not Submit Highly Sensitive Information
You should not submit information that is unnecessary to understanding the reported incident, particularly:
- Social Security numbers;
- passwords;
- authentication credentials;
- bank-account numbers;
- credit-card numbers;
- complete government identification numbers;
- private home addresses;
- personal telephone numbers;
- detailed medical records;
- biometric identifiers;
- information identifying minors;
- trade secrets; or
- confidential information you do not have the right to disclose.
Before uploading a document, review it carefully and redact information that is not necessary to understand the incident.
Wayward Fowl may redact, restrict, or remove sensitive information from a Submission.
7Information About Other People
Your incident may involve other individuals.
You should include personally identifying information about another person only when reasonably necessary to understand the incident.
Do not use Wayward Fowl to:
- expose someone’s private information for purposes of harassment;
- threaten or intimidate another person;
- encourage harassment;
- retaliate against another person;
- impersonate another person; or
- intentionally cause unlawful harm.
Wayward Fowl may redact the names or identifying information of individuals where appropriate.
8Employment And Confidential Information
If your report concerns an employer, former employer, customer, contractor, or other organization, you remain responsible for complying with applicable legal obligations concerning information you disclose.
Do not knowingly submit trade secrets or information you are legally prohibited from disclosing.
Wayward Fowl does not provide legal advice regarding confidentiality agreements, employment agreements, nondisclosure agreements, trade-secret obligations, court orders, or other restrictions.
If you are uncertain whether you may lawfully disclose particular information, consider obtaining legal advice before submitting it.
9Your Identity
Wayward Fowl may permit reports to be displayed publicly without displaying the reporter’s name.
However, anonymous or pseudonymous public display does not necessarily mean that Wayward Fowl itself will not collect or retain information concerning the reporter’s identity.
Wayward Fowl’s collection and use of identifying information are governed by its Privacy Policy.
Wayward Fowl cannot guarantee that a reporter’s identity will never be discovered or disclosed.
Information may be disclosed where required by applicable law, valid legal process, or as otherwise described in the Privacy Policy.
10Review And Verification
Wayward Fowl may review a Submission before or after publication.
Wayward Fowl may request:
- additional information;
- supporting documentation;
- clarification;
- verification of identity;
- verification of relevant communications; or
- other information reasonably related to a Submission.
Wayward Fowl is not obligated to independently investigate or verify every Submission.
Publication of a Submission does not mean that Wayward Fowl has independently verified the report or determined that its allegations are true.
11Editorial And Moderation Rights
You authorize Wayward Fowl to exercise reasonable editorial and moderation discretion regarding your Submission.
Wayward Fowl may:
- correct formatting;
- correct obvious typographical errors;
- organize information;
- categorize incidents;
- create headings;
- redact personal or sensitive information;
- remove prohibited material;
- summarize a Submission;
- identify relevant AI systems or organizations;
- add contextual information;
- identify the status of a report;
- combine substantially duplicative reports;
- request additional information;
- delay publication;
- decline publication;
- restrict distribution; or
- remove previously published material.
Wayward Fowl may preserve the substance of a reporter’s allegations while changing how information is formatted or presented.
Wayward Fowl is not obligated to publish any Submission.
12Publication And License
You retain whatever ownership rights you otherwise possess in content you submit to Wayward Fowl (“User Content”).
By submitting User Content, you grant Wayward Fowl a worldwide, nonexclusive, royalty- free, sublicensable, and transferable license to host, store, reproduce, format, adapt, display, publish, distribute, communicate, index, categorize, excerpt, summarize, analyze, and otherwise use the User Content as reasonably necessary to:
- operate and improve the Platform;
- review, moderate, document, and publish incident reports;
- investigate and evaluate reported incidents;
- maintain searchable and historical incident records;
- provide corrections, updates, responses, and dispute histories;
- identify patterns and related incidents;
- produce aggregated or de-identified statistics, research, and analysis;
- develop Platform features and analytical tools;
- enforce these Terms and other Platform policies; and
- protect the integrity, security, and lawful operation of the Platform.
For User Content that Wayward Fowl publishes as part of the public incident record, this license is perpetual and irrevocable to the extent reasonably necessary to preserve, archive, display, document, analyze, and maintain the integrity and historical continuity of that public record, subject to applicable law and Wayward Fowl's Privacy Policy, Corrections and Dispute Policy, and removal practices.
Closing your account, withdrawing a report, or requesting deletion does not automatically terminate Wayward Fowl's rights with respect to content previously published or incorporated into correction histories, dispute records, aggregated information, de- identified information, research, or analysis.
However, Wayward Fowl may remove, redact, anonymize, restrict, or discontinue publication of User Content in accordance with applicable law and Platform policies.
Nothing in this license gives Wayward Fowl ownership of your User Content.
13Contacting Organizations Identified In Your Report
Wayward Fowl may contact a company, organization, AI developer, employer, government entity, or other party identified in your Submission.
Wayward Fowl may provide that party with information concerning the allegations in your Submission and may invite that party to:
- respond;
- provide context;
- dispute information;
- provide documentation; or
- request correction.
Any response may be published alongside or in connection with your report.
If Wayward Fowl offers functionality allowing you to request that your identity remain confidential when contacting a named organization, Wayward Fowl will handle that request in accordance with the applicable Platform policies and Privacy Policy.
14Corrections
If you later discover that material information in your Submission was inaccurate or incomplete, you should notify Wayward Fowl promptly.
Wayward Fowl may correct, annotate, update, restrict, or remove a report when appropriate.
Wayward Fowl may also maintain a record indicating that a report has been corrected or updated.
15Disputes By Named Parties
A person or organization identified in your Submission may dispute your account.
Wayward Fowl may review information provided by both sides and may:
- leave the report unchanged;
- add the response;
- add contextual information;
- correct information;
- change the report’s status;
- restrict certain information; or
- remove material.
A dispute by a named party does not automatically require Wayward Fowl to remove a report.
Likewise, Wayward Fowl’s decision to leave a report published does not constitute a determination that the report is true.
16No Guarantee Of Confidentiality
Unless Wayward Fowl expressly agrees otherwise in writing, information submitted through the incident-reporting process should not be treated as privileged or legally confidential communications with Wayward Fowl.
Wayward Fowl is not your attorney and does not create an attorney-client relationship by receiving a Submission.
Do not submit information to Wayward Fowl on the assumption that it will receive attorney- client privilege, attorney work-product protection, or another legal privilege.
17Legal Process
Protection of Reporter Identity
Wayward Fowl recognizes that some individuals may have legitimate concerns about retaliation or other consequences associated with reporting an AI-related incident.
Where a reporter submits information on an anonymous or pseudonymous basis, or where Wayward Fowl otherwise agrees to keep the reporter's identity nonpublic, Wayward Fowl will not voluntarily disclose the reporter's nonpublic identity to a person or organization identified in the report merely because that person or organization requests the information.
If Wayward Fowl receives a subpoena, court order, or other legal demand seeking information that could identify an anonymous or pseudonymous reporter, Wayward Fowl will evaluate the request and its legal obligations. Where legally permitted and reasonably appropriate, Wayward Fowl may object to, seek to narrow, or challenge legal process seeking disclosure of a reporter's identity.
Where legally permitted and reasonably practicable, Wayward Fowl may attempt to notify the affected reporter before disclosing information that identifies the reporter so that the reporter may have an opportunity to seek independent legal advice or pursue available legal remedies.
Nothing in this policy guarantees absolute anonymity or confidentiality. Wayward Fowl may disclose information where required by applicable law or valid legal process and cannot guarantee that an individual's identity will never be independently discovered.
18No Retaliation Protection
Wayward Fowl does not control employers, companies, government agencies, or other third parties.
Submitting a report does not guarantee that you are legally protected from retaliation or other consequences arising from your disclosure.
Certain whistleblower or other legal protections may apply in some circumstances, but Wayward Fowl does not determine whether you qualify for those protections.
If retaliation or confidentiality is a significant concern, consider obtaining legal advice before submitting identifying information.
19Not A Government Or Legal Filing
Submitting an incident to Wayward Fowl does not:
- file a complaint with a government agency;
- commence a lawsuit;
- initiate an administrative proceeding;
- constitute notice to your employer;
- constitute notice to an AI provider;
- preserve a statute of limitations;
- extend a filing deadline;
- satisfy a contractual notice requirement; or
- preserve any other legal right.
You remain responsible for separately pursuing any legal, regulatory, administrative, employment, or contractual remedy available to you.
20No Payment For Submissions
Unless Wayward Fowl expressly agrees otherwise in writing, you are not entitled to compensation, royalties, or other payment because you submit information or because Wayward Fowl publishes, analyzes, or otherwise uses a Submission in accordance with these Submission Terms and the Terms of Use.
21Removal Requests
You may request that Wayward Fowl review a previously submitted report for removal.
A removal request does not guarantee that the report or all information derived from it will be deleted.
Wayward Fowl may retain information where reasonably necessary for:
- legal compliance;
- dispute resolution;
- fraud prevention;
- security;
- enforcement of Platform policies;
- maintenance of correction histories;
- aggregated or de-identified research; or
- other purposes permitted by applicable law and the Privacy Policy.
22Relationship To Other Terms
These Submission Terms supplement the Wayward Fowl Terms of Use.
Your use of the Platform is also subject to the applicable:
- Terms of Use;
- Privacy Policy;
- Legal Disclaimer;
- Content and Community Guidelines; and
- Corrections and Dispute Policy.
If these Submission Terms conflict with the general Terms of Use regarding the submission of an incident report, these Submission Terms shall govern with respect to the Submission to the extent stated in the Terms of Use.
