A putative class action filed in August 2021 in Palm Beach County, Florida, and removed to the Southern District of Florida, alleged that Honorlock's online proctoring software scanned students' facial geometry to verify their identities and used AI to monitor them and flag suspicious behavior, collecting biometrics from Illinois residents without the written consent the Illinois Biometric Information Privacy Act requires. The court sent the claim to arbitration in June 2022, and the plaintiff voluntarily dismissed it in October 2022; the allegations were never proven.
