The class action alleges that Humana improperly uses an artificial intelligence tool called nH Predict when deciding whether to pay for post-acute care for Medicare Advantage patients. The complaint alleges the model's predictions are highly inaccurate and not based on patients' medical needs, and that it uses rigid and unrealistic recovery predictions to cut off payment well before the roughly 100 days of nursing home care the suit says patients are usually eligible for. Humana declined to comment on the litigation and said adverse coverage decisions are made only by physician medical directors.
